By accessing and using the IMMERGITY Immigration website and services ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Platform or services.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and IMMERGITY Immigration ("IMMERGITY," "we," "us," or "our"). Your continued use of the Platform signifies your acceptance of any modifications to these Terms.

User Responsibilities
As a user of our Platform, you agree to:

Lawful Use
Use the Platform only for lawful purposes and in accordance with these Terms

Account Security

Paid Services
Consulting services provided by our licensed RCIC are subject to fees as outlined in individual service agreements or consultation packages.
Payment Terms
All fees are quoted in Canadian Dollars (CAD)
Payment is due as specified in your service agreement
We accept major credit cards, debit cards, and electronic transfers
Receipts will be provided for all payments
Government application fees are separate and paid directly to authorities
Refund Policy
Assessment services are non-refundable once completed
Consultation services: Refunds available within 24 hours of booking if consultation has not occurred
Retainer fees for application services: Subject to refund terms in individual service agreements
No refunds for completed work or services rendered
Government fees paid to IRCC or provincial authorities are non-refundable
Late Payment
Overdue accounts may incur interest charges at the rate permitted by law
Services may be suspended for non-payment
We reserve the right to use collection agencies for unpaid balances
Changes to Fees
We reserve the right to modify our fees at any time
Existing service agreements will honor original pricing
You will be notified of fee changes before they take effect

Approval of any immigration application

Invitation to Apply (ITA) in Express Entry

No Guarantees
Immigration outcomes depend on many factors beyond our control
IRCC and provincial authorities make final decisions on all applications
Immigration policies and rules can change without notice
CRS scores and eligibility can fluctuate based on draws and policy changes
Information Accuracy
While we strive for accuracy, we cannot guarantee that all information on the Platform is current, complete, or error-free
Immigration rules change frequently and information may become outdated
You should verify critical information with official government sources
Our assessments are based on the information you provide
AI-Powered Services
AI recommendations are generated based on algorithms and historical data
AI insights should be considered advisory only, not definitive
We recommend consulting with a licensed RCIC before making critical decisions
AI accuracy improves over time but may not be perfect
Platform Availability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of content
Uninterrupted or error-free operation

The Platform will be available at all times

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMMERGITY SHALL NOT BE LIABLE FOR:
Any direct, indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Business interruption
Failure to secure immigration approval
Consequences of changed immigration policies
Actions or inactions of IRCC or provincial authorities
Third-party services or content
Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Professional Liability
IMMERGITY's licensed RCICs carry professional liability insurance as required by the College of Immigration and Citizenship Consultants (CICC)
Claims related to professional services must be made in accordance with CICC regulations
Professional liability insurance does not cover general Platform use or free services
Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
Natural disasters, pandemics, or public health emergencies
War, terrorism, or civil unrest
Government actions, strikes, or labor disputes
Internet service failures or power outages
Changes to immigration laws or policies by government authorities

You may NOT:
Modify, copy, distribute, or create derivative works
Reverse engineer or extract source code
Use content for commercial purposes
Remove copyright or proprietary notices
Frame or mirror any Platform content
User-Generated Content
By submitting content (reviews, comments, feedback):
You grant us a worldwide, royalty-free license to use, modify, and display your content
You represent that you own the rights to submitted content
You waive any moral rights to user-generated content
We may use your feedback to improve services without compensation
DMCA Compliance

Effect of Termination
Upon termination:
Your right to access the Platform immediately ceases

Unpaid fees become immediately due

Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Jurisdiction
You irrevocably submit to the exclusive jurisdiction of the courts of Ontario for resolution of any disputes arising from these Terms or your use of the Platform.
Dispute Resolution Process
Step 1: Direct Communication
If you have a dispute, first contact us at info@immergityimmigration.com. We will attempt to resolve the issue informally within 30 days.
Step 2: Mediation
If informal resolution fails, both parties agree to attempt mediation before pursuing litigation. Mediation will be conducted by a mutually agreed mediator in Ontario, Canada.
Step 3: Arbitration (Optional)
If mediation fails, disputes may be submitted to binding arbitration in accordance with the Arbitration Act of Ontario. The arbitration will be conducted in English in Mississauga, Ontario.
Exceptions to Alternative Dispute Resolution
The following matters may proceed directly to court:
Claims for injunctive or equitable relief
Intellectual property disputes
Collection of unpaid fees
Enforcement of confidentiality obligations
Class Action Waiver
YOU AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Time Limitation
Any claim or cause of action arising from these Terms or use of the Platform must be filed within one (1) year after the claim arose, or it will be permanently barred.
Professional Complaints
Complaints about professional services provided by our licensed RCICs may also be filed with:
College of Immigration and Citizenship Consultants (CICC)

Changes to Terms
Modification Rights
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion.
Notification of Changes
When we make material changes to these Terms:

We will update the "Last Updated" date at the top
We may send you an email notification (if you have provided an email address)
We may display a notice on the Platform
Effective Date
Changes become effective:
Immediately upon posting for non-material changes
30 days after notice for material changes
As specified in the notice for significant policy changes
Your Acceptance
By continuing to use the Platform after changes take effect, you accept the modified Terms. If you do not agree with the changes:

You may terminate your account

General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and IMMERGITY regarding use of the Platform and services.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of IMMERGITY.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent
We may assign these Terms to any affiliate or successor without your consent
Any unauthorized assignment is void
No Partnership
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and IMMERGITY. You have no authority to bind IMMERGITY in any way.
Headings
Section headings in these Terms are for convenience only and do not affect interpretation.
Language
These Terms are provided in English. If translated, the English version governs in case of any discrepancy.
Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government restrictions, labor strikes, or failures of telecommunications or Internet infrastructure.
Third-Party Rights
These Terms are for the benefit of the parties only and do not confer rights on any third parties.
Electronic Communications
You consent to receive electronic communications from us, including emails, notices posted on the Platform, and messages sent through the Platform. These electronic communications satisfy any legal requirement that communications be in writing.
Equitable Remedies
You acknowledge that a breach of these Terms may cause irreparable harm for which monetary damages are insufficient. We are entitled to seek injunctive or other equitable relief without posting a bond.
Indemnification
You agree to indemnify, defend, and hold harmless IMMERGITY, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
Your use of the Platform
Your violation of these Terms
Your violation of any third-party rights
Information you provide that is false, misleading, or inaccurate
Any immigration application issues resulting from your incomplete or inaccurate information
